1. Intro

  • 1.1

    As a global trust platform, anyone can use Eachthing no matter who they are, where they live, and what they believe. This is why you’ll see an extremely wide range of petitions, as they’ve all been created by people in the community.

    Our role is to make sure the platform is a powerful vehicle for trust and transparency while remaining as safe as possible for our users. That’s why we’ve put together these "Organization Community Guidelines" which, along with our "Terms of Service" and "Master Subscription Agreement", outline the rules for using Eachthing as an Organization.

2. Inviting users to submit recommendations of the Organization

  • 2.1

    We difine a Consumer as a user ("User") and someone who:

    • has purchased an Eachthing Identity from an Organization etc. ("the Organization"), or
    • has tried to buy an Eachthing Identity with the Organization, or
    • owns an Eachthing Identity from the Organization, or
    • can otherwise document a relevant encounter with the Eachthing Identity, including via correspondence or other interaction with the Organization, or
    • can document that the recommendation of the information was created based on a trustworthy source and related to the Eachthing Identity.

    (These are collectively referred to as "Identity Experience" in the following.)

  • 2.2

    When the Organization sends invitations to its Users inviting them to recommendation an Eachthing Identity, the Organization must observe the following rules. The rules apply regardless of whether recommendation invitations are sent via the Organization’s own system or through our recommendation invitation services:

    1. The Organization must ensure that Users are invited equally and identically to submit recommendations about their experience with the Eachthing Identity.
    2. The Organization may not selectively invite Users to submit recommendations; as a general rule, the Organization must invite all or none of its Users. If the Organization wishes to deviate from the principle of all or none, the Organization must ensure that the Users who are invited to submit recommendations are selected in an objective, unbiased manner. For example, this could mean inviting every third User.
    3. The language in the recommendation invitation must be neutral, unbiased and independent of whether the User is expected to have had a positive or negative experience with the Eachthing Identity. It must not include any attempts to (i) influence the User to recommendation the Eachthing Identity in a positive or negative manner, (ii) attract specific types of Users, or (iii) otherwise artificially achieve an outcome desired by the Organization.
    4. If the Organization has offered an incentive to Users to write recommendations, this information must be shown on their Organizations Identity detail page on Eachthing. The Organization must inform Eachthing about the use of incentives by sending an email to compliance@eachthing.com. Incentives include the Organization offering Users a gift, reward, discount or advantage for writing a recommendation about the Organizations Eachthing Identities.

3. Replying to recommendations, including publishing reasons for reporting recommendations

  • 3.1

    The Organization has the option of replying to recommendations on Eachthing. If the Organization replies to recommendations, the Organization warrants in every context that the replies:

    • are not unlawful, offensive, deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, defamatory, tortious, obscene, pornographic or profane,
    • do not have a sexist, political or racially discriminating character,
    • do not violate other people’s rights, including any intellectual property rights and privacy rights,
    • do not in any way breach any applicable local, national or international laws or regulations,
    • do not have a disloyal or unlawful purpose and/or content (or promote unlawful purposes), and
    • are not technically harmful (including without limitation containing computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software, harmful data or conduct).
  • 3.2

    If a recommendation doesn’t meet our guidelines, you can report it to our Compliance Team, along with an explanation (also called a "Public Reporting Reason") to our community as to why it doesn’t belong on Eachthing. The reported recommendation will be temporarily hidden while we investigate it, but your reason for reporting will be visible to everyone.

    The above rules about replies to recommendations on Eachthing also apply to the Organization’s use of the Public Reporting Reason.

    If we receive notice or otherwise become aware that the replies or the Public Reporting Reasons violate these Guidelines, we may delete the replies or the Public Reporting Reasons without notice, and may inform the affected parties and/or the authorities of the violation - depending on the nature of the violation. Our right to delete is not conditional upon providing an explanation, although we will strive to inform the Organization about any deletions and the reason for them.

4. Use of owner based verification

  • 4.1

    In case the Organization uses Unique Eachthing Identifications ("Things"). Organizations can enable a function to require Users to validate the Ownership of the Thing before submitting recommendations. To learn more about this feature, please contact our support team.

5. Use of the Eachthing brand

  • 5.1

    The Organization will be able to see whether it is entitled to use Eachthing logos, graphics and trademarks ("Eachthing Designs") in the dashboard module on Eachthing.

    If the Organization is entitled to display the Transparency Scores, Environmental Scores, Identity rankings, and other Eachthing data in its marketing materials, on its website, etc., and does so, the Organization must ensure that it does not display these in a misleading, biased or otherwise deceptive way. The Organization must make sure that they alway display all scores, rankings and data in an accurate way that reflects the Organization’s actual scores, ranking and data. The Organization’s responsibility to accurately display Eachthing information extends to its use of widgets and similar services.

    If the Organization is entitled to display recommendations, the Organization agrees that it must remove and delete any displayed recommendations if so requested by the Users who wrote the recommendations in question, or by us e.g. if the recommendations violate these Guidelines.

6. The Organizations profile page

  • 6.1

    In the dashboard module on Eachthing, the Organization may have the ability to include information, logos, trademarks and designs about the Organization and all related Brands, Product Types, Batches and Things ("Eachthing Identities"). This will be shown on the Eachthing Identity’s profile page. The Organization must not include information that can be misleading, deceptive, defamatory or otherwise in violation of applicable laws. In addition, the Organization warrants that - if the Organization includes information, logos, trademarks and designs - it has all rights to do so and that these logos, designs and trademarks do not violate any third party rights.

7. Fabricated recommendations

  • 7.1

    Eachthing’s purpose is to provide an online recommendation community where Users can freely share their Identity Experiences with the Organization and thereby provide an informative view of the Organization’s identities.

    Trust is crucial to us, and we do not under any circumstances accept fabricated recommendations. Fabricated recommendations are those that do not reflect a genuine Identity Experience, because, for example, they are created by or on behalf of the Organization itself.

    We consider the direct and indirect creation of fabricated recommendations a material breach of the agreement between the Organization and us. It is irrelevant how the fabricated recommendations are created, including whether they are created by employees of the Organization or by external consultants.

    We use specially developed software to detect fabricated recommendations. Reviews that we deem fabricated, fake or similar will be deleted, moved or highlighted, and we are entitled to publish information about this in connection with the Organization’s profile on Eachthing.

8. Reviews written by the Organization’s employees

  • 8.1

    The Organization is not permitted to invite or otherwise encourage its employees, former employees, owners or directors, or their family members to write recommendations about the Organization.

9. Collection of recommendations on the Organizations’s equipment

  • 9.1

    The Organization may not provide equipment for Users to recommendation the Organizations Eachthing Identities. Our specially developed software for detecting fabricated recommendations will detect and remove recommendations that originate from the same IP address.

    We can grant permission to the Organization to collect recommendations on its own premises - but never through the Organization’s equipment - if the Organization contacts us prior to collection by email at compliance@eachthing.com and:

    • Informs us about how recommendation collection will take place
    • Provides us with the Organization’s IP addresses and locations, and
    • Guarantees that these Guidelines will be respected, including the requirements set out in section 2.

    However, we reserve the right to reject such requests and to withdraw our permission at any time, without prior notice or justification.

10. Removal of recommendations

  • 10.1

    We host recommendations as user-generated content. The removal of recommendations is exclusively a matter between the Users and us, and our User Guidelines regulate if and when we remove recommendations. For the avoidance of doubt, we do not remove recommendations, when for example:

    • The Organization and the User disagree on the course of events. It is practically impossible to prove who is right, and in these cases, we suggest that the Organization replies to the recommendation so that other users can see the Organization’s version, The User’s recommendation and the number of awarded stars seem inconsistent, e.g. if the User awarded the Organization only one star, but wrote a very positive recommendation of the Organization, or The Organization thinks the recommendation is "unfair", e.g. because the dissatisfaction is a result of a mistake made by a supplier. Whether a User feels satisfied or dissatisfied is exclusively the User’s subjective opinion, and whether or not the User’s dissatisfaction is appropriate is not a matter for us to decide. Such issues are left to be resolved between the involved parties, i.e. the Organization and the User.

11. Misuse of the reporting and notification functions

  • 11.1

    It is possible for the Organization to report recommendations that the Company believes violate our User Guidelines. The Organization must not misuse this reporting functionality.

    Examples of misuse include, but are not limited to:

    • Carrying out unfounded or incorrect reporting of many or all negative recommendations,
    • Carrying out unfounded or incorrect notification of competitors’ positive recommendations, or
    • Reporting the same recommendation multiple times when that recommendation has already been assessed in accordance with our internal quality process, unless exceptional circumstances apply.

    We consider such behaviour a material breach of the agreement between the Organization and us.

12. Threats against Users and Eachthing employees

  • 12.1

    Organizations may not threaten, abuse or blackmail Users. Threats include making unjustified claims for damages in order to have specific recommendations (typically negative) removed.

    Further, we do not tolerate threats against Eachthing employees. Under no circumstances will we accept such behaviour.

    We consider threatening or abusive behaviour a material breach of the agreement between the Organization and us, which can lead to us immediately blocking the Organization’s account and filing a report with the relevant authorities.

13. Suspending or blocking the Organization’s account

  • 13.1

    We may at any time, without notice and without prejudice, suspend or block the Organization’s access to their account or/and specific features in the account if we believe or suspect that the Organization is carrying out behaviour that is inappropriate or in violation of the Guidelines or applicable laws or regulations. When the Organization’s business account or/and specific features are suspended or blocked, the Organzaition will not have access to services which require the Organization’s registration and/or login, such as reporting or responding to recommendations.

14. Enforcement

  • 14.1

    We reserve the right to enforce these Guidelines if we observe violations of them or of applicable laws or regulations. The same applies if we observe behaviour that we believe or suspect to be inappropriate.
